Debt Collection Defense

Are you being sued for the collection of an old credit card debt by a company you never heard of before? Midland Funding, Portfolio Recovery Associates, LVNV, Cavalry SPV, Sherman Financial Group. There are too many to name.

These companies buy defaulted debts and try to collect them. They buy the debts in large quantities and file tens of thousands of debt collection lawsuits.

If you are served with legal papers, do not ignore them. That is the worst thing you can do. If you ignore the lawsuit, the creditor will obtain a default judgment it can use against you. If the creditor can find out where you bank, they may use the judgment to garnish your bank account, which is a terrible experience. Without warning, your bank account is frozen and money you were counting on is unavailable.

The good news is debt collection lawsuits brought by debt buyers can often be defended. Debt buyers file cases by the tens of thousands, often without vetting them. Sometimes the debt buyer cannot prove they actually acquired your account. They often do not have key documents, such as signed account agreements. They may be suing you after the statute of limitations has passed. Maybe the creditor or their attorneys are doing something that violates the Fair Debt Collections Practices Act, giving you a right to sue them.

You are better off with an attorney to represent you. An attorney can gauge the strength of the case against you. An attorney may be able to win the case and make the debt go away for good. Legal representation gives you more leverage to negotiate a settlement.
